Aqualand of the Free – Camp Terms and Conditions

By registering for any camp, activity, or event hosted by Aqualand of the Free LLC (“Aqualand”), you agree to the following terms and conditions:

1. Assumption of Risk and Release of Liability

Participation in beach, bay, and ocean-based activities involves inherent risks, including but not limited to: changing surf conditions, strong currents, marine life, sun exposure, dehydration, injury, and equipment use. By enrolling, you assume full responsibility for these risks on behalf of yourself and/or your child.

You agree to release and hold harmless Aqualand of the Free LLC, its owners, employees, contractors, volunteers, and affiliates from any and all claims, liabilities, or causes of action related to injury, illness, property loss, or death arising from participation in camp programs.

2. Waiver of Liability for Public Agencies

You acknowledge that Aqualand programs may operate on or near public beaches and tidelands managed by various state and municipal entities. These entities do not sponsor, operate, or oversee Aqualand programming and shall not be held liable for any injury or damages associated with it.

You expressly waive and release any and all claims—whether in contract, tort, or otherwise—against the following entities and their employees, officials, and agents:

  • State of California

  • California Coastal Commission

  • California State Lands Commission

  • City of Long Beach

  • City of Seal Beach

  • City of Huntington Beach

  • Surfside Colony and affiliated entities

  • Any other public agency with jurisdiction over coastal lands, state tidelands, or access points used by Aqualand

This release applies even in the event of alleged negligence on the part of these agencies.

3. Camper Code of Conduct

Campers are expected to:

  • Follow all safety instructions immediately and completely

  • Treat staff, peers, and the natural environment with respect

  • Remain with their assigned group unless explicitly permitted to separate

  • Participate in activities to the best of their ability

  • Refrain from aggressive, disruptive, or inappropriate behavior - including but not limited to throwing, kicking sand or touching other campers and staff in an aggressive or inappropriate manner.

  • No phone use without permission and in the case of an emergency

Failure to comply may result in a warning, suspension from activities, or dismissal from camp without refund. Decisions are made at the discretion of camp leadership to protect the safety and wellbeing of all participants. Aqualand reserves the right to remove any camper at any time and at our discretion.

Attending Aqualand is a privilege, not a right.

4. Emergency Care and Medical Consent

You authorize Aqualand staff to administer first aid and, if necessary, seek medical treatment for your child in the event of an emergency. You understand that Aqualand does not carry medical insurance and that you are responsible for any resulting medical expenses.

5. Media Release

Unless you notify us in writing, you grant Aqualand permission to use photographs or video of your child participating in camp activities for promotional use across print, digital, and social media platforms.

6. Refund, Weather, and Cancellation Policy

Cancellations must comply with Aqualand’s posted policy. In the case of adverse weather, unsafe surf, beach closures, or other factors outside Aqualand’s control, a make-up session or credit will be offered when possible. Full refunds are not guaranteed in these cases.

CANCELLATION POLICY FOR CAMPS & CLASSES

Please take a moment to review our updated cancellation policy camps and classes. We are a small family business and we do our best to keep our camps affordable for families. This means we do a lot of the jobs, including behind the computer admin & registration. We care a lot about your kids and hope to spend as much time with them as possible! A reasonable cancellation policy ensures that you respect our time and that we can pay staff and run camp effectively. Our programs are non-refundable unless cancelled one week in advance. Upon this cancellation, you will be refunded 75% of the amount minus the 25% deposit. Please register with some level of certainty in your scheduling, or with the understanding that you are putting down a 25% non-refundable deposit.

REFUNDS

For all Aqualand programs, refunds minus a 25% non refundable deposit will be granted for cancellations made by 6pm on the Monday one week prior to the start of camp the following Monday. This will allow us time to rebook another camper. Refunds will not be issued for “no shows”. Refunds must be requested by emailing info@aqualandofthefree.com. If a refund request is made in time, Aqualand will offer a refund of the 75% based upon the original payment method. In addition, please note the following: (i) days missed in weekly and monthly class sessions will not be refunded; and (ii) make-up classes will be up to the digression of Aqualand.

7. Governing Law

These terms shall be governed by and interpreted in accordance with the laws of the State of California, with jurisdiction for any disputes in the courts of Los Angeles or Orange County.

 

8. Pricing



The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page. 

The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your selected payment method.

 

9. Use of Site & Services

You agree to indemnify and hold Aqualand Of The Free harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

To the maximum extent permitted by applicable law, Aqualand Of The Free assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein

10. Contact

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time via info@aqualandofthefree.com.

 

11. Changes to services and offerings

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

12. Non-Sectarian

Aqualand’s programs shall remain non-sectarian and open to all regardless of religion, background. We welcome and respect all individuals and are committed to maintaining a safe and supportive environment for all participants.
